Terms of Service

By creating an Evenly account or using the app, you agree to these Terms of Service. If you do not agree, please do not use Evenly. Our Privacy Policy explains how we handle your information and forms part of this agreement.

1. Who can use Evenly

You must be at least 18 years old and able to form a binding contract. You may not use Evenly if you are barred from receiving our services under the laws of your country or any other applicable jurisdiction. If you use Evenly on behalf of an organisation, you confirm you are authorised to accept these terms for it.

2. What Evenly does

Evenly is a shared-expense app. You record expenses, choose how they are split, and Evenly calculates the balances between you and the people you split with. It works both after the fact and in real time at the table. It supports multiple currencies, and can read a receipt you photograph and turn it into line items.

3. What Evenly does not do

• It does not hold, receive, transmit or transfer money. No funds ever pass through Evenly or through us.
• It is not a payment service. Payment buttons in Evenly are links that open your own payment app, such as Venmo, PayPal, Cash App or a UPI app. The payment happens there, between you and the other person, under that provider’s terms. We are not a party to it.
• It cannot confirm, guarantee, reverse or recover a payment. Marking a debt as settled in Evenly is a note that you made, not proof that money moved. If someone marks something settled and has not actually paid you, that is between you and them.
• It is not legal, financial, tax or accounting advice.

4. Balances are informal records

The debts, IOUs and balances shown in Evenly are informal records that you and the people you split with have chosen to keep. They are not legally binding contracts, and Evenly does not create, enforce or adjudicate any debt between you. You agree that you understand this.

Balances are only as accurate as what people enter. Evenly does the arithmetic; it cannot know whether an expense was real, whether the split was fair, or whether someone actually paid. Disputes about who owes what are between the people involved.

5. Your account

• Give us accurate information, and keep it current.
• Keep your account secure. You are responsible for activity under your account. Tell us promptly if you believe someone else has access to it.
• One account per person. Do not create an account for someone else without their permission, or impersonate anyone.
• You can delete your account at any time from Account → Danger zone. Section 8 of the Privacy Policy explains what happens to shared records when you do.

6. Who owns what

What we own

Evenly is ours. The app and everything that makes it what it is — its software, design, layout, screens and interactions, text, graphics, and the Evenly name and logo — belongs to In The Trenches LLC, and is protected by copyright, trademark and other laws. Using Evenly does not transfer any of it to you.

We give you a personal, limited, non-transferable, revocable licence to use Evenly for its intended purpose. You may not copy, reproduce, adapt, republish, sell or create derivative works from any part of it, or use our name or logo, without our written permission. You may not reverse engineer or decompile the app, except to the extent the law expressly permits it (for example, where you have a statutory right to do so for interoperability).

What you own

You keep ownership of the content you put into Evenly — your expenses, descriptions, comments, receipt images and profile details. You grant us a limited licence to store, process and display that content for the sole purpose of operating Evenly for you and the people you share it with. We do not use your content to advertise to you and we do not sell it.

Evenly is shared by design. When you add someone to an expense or a group, they can see what you share with them. Do not put anything into a shared expense that you would not want the other people in it to read.

7. Acceptable use

Do not:

• use Evenly for anything unlawful, fraudulent, or harmful to others;
• add people who have not agreed to be added, or use Evenly to harass or spam anyone;
• upload content that is illegal, abusive, hateful, or infringes someone else’s rights;
• attempt to access another person’s account or data, probe or bypass our security, or interfere with the service;
• scrape, resell, or build a competing service from Evenly’s data or interfaces;
• abuse promotional credits, referral rewards, or free-tier limits, including by creating multiple accounts to do so.

8. Receipt scanning

Scan-to-itemize uses automated character recognition to read a receipt. It is not guaranteed to be accurate. Prices, quantities, tax and tips can be misread, especially on a creased, blurry, faded or unusual receipt. Always check the result before you split it. You are responsible for what you confirm.

Attaching a receipt photo to an expense is a separate, free feature, and does not send the image for scanning. Section 7 of the Privacy Policy explains where a scanned image goes.

9. Plans, purchases and credits

Evenly offers:

• Free — the tier every account starts on, with usage limits that are shown to you in the app.
• Lifetime Plus — a one-time purchase that unlocks its features for as long as we offer Evenly. We also grant Lifetime Plus free to certain groups under promotional names such as Founder Pass and First 300.
• Premium — a recurring subscription, billed monthly or annually.
• Pro Packs — one-off top-ups, such as additional receipt scans, which any account can buy on any tier.

What each tier includes, and the limits on the Free tier, are shown in the app and may change. This page deliberately does not list them, so that what you see in Evenly is always the current answer.

Billing

• All purchases are made through the Apple App Store or Google Play, not by us. We never see or handle your card details. Billing, renewals, cancellations and refunds are governed by that store’s terms and policies.
• Subscriptions renew automatically until you cancel. Cancel at least 24 hours before the end of the current period, in your App Store or Google Play account settings. Cancelling stops the next renewal; it does not refund the period you are in.
• Pro Packs are consumable. Once used, they are used. They are not refundable by us and they have no cash value.
• We may change prices and what a tier includes. For subscriptions we will give you notice before a change takes effect, and you can cancel. Changes are not retroactive: a one-time purchase you have already made stays honoured on the terms you bought it under.
• Promotional grants and referral rewards — including Founder Pass and First 300 — are free, personal to you, non-transferable, have no cash value, and may be withdrawn if they are obtained or used abusively.
• Purchases are tied to your Evenly account and are not transferable between accounts.

10. Third-party services

Evenly links to and works with services we do not control, including payment apps, the app stores, and the providers listed in our Privacy Policy. We are not responsible for those services, their availability, or their terms. Your use of them is between you and them.

11. Availability and changes to the service

We may add, change, suspend or remove features, and we may limit or discontinue Evenly in whole or in part. We will give reasonable notice where we can. Evenly depends on services we do not control and may be unavailable at times.

12. Suspension and termination

You may stop using Evenly and delete your account at any time. We may suspend or terminate your account if you breach these terms, if we are required to by law, or if we reasonably believe your use puts other users or the service at risk. Where it is appropriate and lawful, we will tell you why and give you a chance to respond. Sections 4, 6, 13, 14, 15 and 17 survive termination.

13. Disclaimer of warranties

EVENLY IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT EVENLY WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT ITS CALCULATIONS OR SCANNED RECEIPT DATA WILL BE ACCURATE OR COMPLETE, OR THAT ANY DEFECT WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing in these terms removes a legal right you have that cannot be waived.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN THE TRENCHES LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR MONEY YOU ARE OWED OR HAVE PAID TO ANOTHER PERSON, ARISING OUT OF OR RELATING TO YOUR USE OF EVENLY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

IN PARTICULAR, AND WITHOUT LIMITING THE ABOVE, WE ARE NOT LIABLE FOR ANY DEBT BETWEEN YOU AND ANOTHER PERSON, FOR A PAYMENT THAT WAS NOT MADE, WAS MADE TO THE WRONG PERSON, OR WAS MADE IN THE WRONG AMOUNT, OR FOR ANY INACCURACY IN AN EXPENSE, SPLIT, BALANCE OR SCANNED RECEIPT.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO EVENLY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) US$50.

Some jurisdictions do not allow these limitations, so they may not fully apply to you.

15. Indemnification

You agree to indemnify and hold harmless In The Trenches LLC and its officers, employees and agents from any claim, loss, liability or expense (including reasonable legal fees) arising out of your use of Evenly, your content, your breach of these terms, or your violation of any law or of another person’s rights.

16. Changes to these terms

We may update these terms. We will change the “last updated” date above, and for significant changes we will notify you in the app before they take effect. Continuing to use Evenly after a change means you accept the updated terms. If you do not accept them, delete your account.

17. Governing law and disputes

These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in New Jersey for any dispute that is not resolved informally. If you live in a country whose law gives you the right to bring proceedings locally, this does not take that right away.

Before filing anything, please email us at support@evenly.net. Most problems are faster to fix than to litigate.

18. General

• If any provision of these terms is held unenforceable, the rest stays in force and the unenforceable part is limited to the minimum extent necessary.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these terms. We may assign them to an affiliate or in connection with a merger, acquisition or sale of assets.
• These terms, together with the Privacy Policy, are the entire agreement between you and us about Evenly, and replace any earlier version.
